"A forensic audit analyzes the computations and representations made in your original loan documentation, whether from a refinance transaction or from when you originally purchased your home. Some loan transactions and documents contain errors such as miscalculating the annual percentage rate (APR) in the truth in lending statement or a lender's failure to provide borrowers with required disclosures. These potential mistakes may have violated various federal and state laws and could be used by borrowers to demand changes in mortgages, such as reductions in the principal balance, interest rate modifications and waiver of past due payments."

"Errors revealed by forensic (loan) audits may also serve as a defense against home foreclosure. Costs vary but the information revealed may help homeowners attempting to keep their homes. A real estate attorney should conduct a forensic audit to determine if mortgage documents violate any state or federal laws."

- excerpt from Saturday's PB Post (03-14-2009)

Comments (1)

Citi announces $500/month payments for the recently unemployed

NEW YORK - In a stunning move yesterday, officials at CitiBank's mortgage division announced its first of a kind program to allow recently unemployed homeowners the ability to pay just $500/month for three months, regardless of their normal monthly mortgage payment. Borrowers who take advantage of this offer will not have their credit adversely affected. The program is available immediately for those unemployed homeowners who have a mortgage that is directly owned by Citi.

Citibank hopes that other banks will follow its lead and did note that many of the loans it services will not be eligible as Citi does not own every loan that they service. This is a great idea put into action by Citi and is especially encouraging given that the level of unemployment continues to rise and put economic pressure on families throughout the country. Hopefully this will encourage more officials and policymakers at the institutional and government level to begin addressing homeowners' needs who have a little savings, but may not have steady streams of income as they struggle to put their financial houses in order. Citi encourages its mortgage customers who may qualify for this assistance to call their regular customer service centers for complete details.

- AmeritrustSolutions.com

Comments (0)

Government Homeowners' Rescue Plan Stalled in Congress

As of this evening, legislators in Washington D.C. have been unable to finalize the much touted homeowners' rescue plan. Still no help is being offered for second homes and investors. Primary homeowners are promised assistance if the bill passes only if they are current or nearly current on their existing obligations. Given this uncertainty one wonders whether or not this legislation in its final form will aid a significant percentage of homeowners at all. As one prominent legislator who spoke on background put it, "Most of my constituents feel that the help will be too little, too late and are taking their own measures to help themselves."

Comments (0)

Obama's Government Backed Loan Modification Plan

The government's recent loan modification plan is a temporary fix. After 5 years you are once again at the bank's and lender's mercy and they will have the right to renegotiate your loan at any term or rate they desire. Investors and second homeowners are not eligible for any assistance at this time.
